Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Arcade Ops website, application, and related services (the "Service") operated by Arcade Ops ("we," "us," or "our"). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. You agree to provide accurate information when creating an account and to keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

2. Subscription plans and billing

• Plans are billed per US state and independently of each other.
• New subscribers may start one 14-day free trial per state. A valid payment method is required to start a trial; nothing is charged during the trial period.
• When the trial ends, the payment method on file is automatically charged $399 for that state's first month, and monthly thereafter, unless you cancel before the trial ends. This is disclosed at checkout and in your portal.
• The monthly plan is $399 per state and renews automatically each month until cancelled.
• All charges are processed by Stripe. By subscribing you authorize us to charge the payment method on file.
• Fees are non-refundable except as required by law or as expressly stated in writing.
• We may change pricing on 30 days' notice; changes take effect at your next renewal.

3. Acceptable use

You agree not to:

• Violate any applicable law, including the TCPA, CAN-SPAM, telemarketing rules, or state consumer-privacy laws.
• Send SMS or voice communications without prior express written consent from the recipient.
• Send unsolicited commercial email or bulk messages that violate anti-spam law.
• Scrape, resell, sublicense, or export Service data in bulk, or use it to build a competing product.
• Download, export, or copy lead data out of the platform. Service data is licensed for use inside the Arcade Ops platform only; subscriber accounts have no export or download capability, and circumventing this (automated collection, screen-scraping, or manual bulk copying) terminates your license.
• Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service.
• Use the Service to harass, defraud, or harm any person or business.

We may suspend or terminate accounts that violate these rules, with or without notice.

5. Data and content

You own the content you submit to the Service. You grant us a limited, non-exclusive license to host, process, and display your content solely to operate the Service. Directory data (business names, addresses, publicly-available contact information) may be sourced from Google Places and other third-party providers under their respective terms.

Bulk export of Service data (including subscriber contact information) is prohibited and is enforced by product controls. Contact-reveal counters and masking are audit tools, not license grants.

6. Third-party services

The Service integrates with third-party services including Stripe, Twilio, Resend, Google Places, Hunter.io, Apollo.io, and Emergent. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party outages, changes, or content.

7. Cancellation and termination

You may cancel any state subscription at any time from your account. Cancellation takes effect at the end of the current billing period; you retain access until then and are not entitled to a partial refund. We may suspend or terminate your account for non-payment or breach of these Terms.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that leads, contact data, or AI-generated content will be complete, accurate, or produce any particular outcome.

9. Limitation of liability

To the maximum extent permitted by law, Arcade Ops and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability for any claim arising out of the Service will not exceed the fees you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Arcade Ops harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Service, your content, your outbound communications, or your violation of these Terms or applicable law.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, except that either party may seek injunctive relief in court for infringement or misuse of intellectual property.

12. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or in-app notice. Your continued use of the Service after the update constitutes acceptance of the revised Terms.
